the same requircments to recoive teachers certificates from the Board
of Education and upon qualifying arc 1gsued identicel certificatces.

The allegations of the complaint as to discrimination, which
are denicd in the anewer,’ but which must be taken as true on the
motion to dismiss, are as followsa:

"11, Defendants over a long period of ycars have consistently
pursued and naintained and arc now pursuing and naintaining thic
policy, custon, and usage cf paying Negro teachcrs and principsls in
the public schools of Norfolk lcss salary than white teachcrs and
principals in said public achool system possessing the sanc profession-
al qualifications, certificates and experience, cxcrcising thc sanc
dutics and performing the sanme scrvices as Negro teachers and
principalse. such discrinination 1s being practiced against the
plaintiffs and 211 other Negro tcachors and principals 1in Norfolk,
Virginia, and is bascd solcly upon thelr race or color,

plaintiff anesociotion and all other Negro teachcrs and principnls in
public schocls in the City of Norfolk arc tcachers by profecssicn and

regulations, custon and practice of the Comnonwealth acting by and
through its agents and agencies, the School Board of the City of
Norfolk and the Superintendcent of Schools of Norfolk, Virginia.

rcgular malc teacher by the defendants since September, 1935, and*is
