My dear Mr. Emerick:
Mills won the case before the United States Dist-
riet Court. In my opinion, the deciding point was that the Board of
Education, without a single exception, had made the colored teachers'!
pay lower then the white, which convinced the Judge that we were dis-
criminating against the colored teachers.
After two days on the stand, the Judge ssked me
e very important question which was as follows: Can you truthfully
say that your best colored teacher is not as good as your poorest
white teacher? I am convinced that my answer to this question con-
vinced the Judge of discrimination. On the whole, I believe that the
white teachers of this County are far superior to the colored teachers
but there are a few exceptionsl colorsd teachers who teach exceptional-
ly well and a few ‘of the white teachers who are below the average and
whose teaching is exceptionally poor. I suppose the same thing exists
in most any of the other counties.
